The suspension of a license to engage in securities registration activities that issued by JSC «First independent registrar» has been extended by three months till 2010, December,7 according to the resolution of the Board of the Agency on September 6, 2010 № 147.

As per decree #254 of the Chairperson of the Agency dated August 31, 2010 “OAPF “Otan” (Subsidiary Company of the “ATFBank”), JSC the license (#3.2.20/34/35 of 08/31/2010) to engage in activity Concerning Collection  of  Pension Contributions, Allocation of Pension Assets  and  Performing  of  Pension Payments and activity on securities market, was renewed, because it has changed its name to “OAPF “Otan”, JSC.

As per decree #250 of the Chairperson of the Agency dated August 25, 2010 “Subsidiary Life Insurance Company of the “BTA Bank” “BTA Life”, JSC was issued the license (#2.2.23 of 08/25/2010) to engage in Life insurance (reinsurance) activity, with inclusion of additional insurance class in the obligatory form of insurance: employee insurance for accidents while he/she performs his/her occupational (office) duties.

As per decree #245 of the Chairperson of the Agency dated August 20, 2010 “Premier Capital”, JSC the license (#0403201023 of 09/19/2008) to engage in investment portfolio management activity, was revoked (Voluntary) (the license (#4.1.1.205 of 08/20/2010) to engage in activity on securities market: brokerage and dealership activity in securities market with the right to maintain the customers accounts as a nominal holder).

As per decree #243 of the Chairperson of the Agency dated August 19, 2010 “Zernovaya Insurance Company”, JSC the license (#2.1.37 of 08/19/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #242 of the Chairperson of the Agency dated August 19, 2010 “Insurance Company “TransOil”, JSC the license (#2.1.2 of 08/19/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #240 of the Chairperson of the Agency dated August 18, 2010 “Subsidiary Life Insurance Company of the “Halyk Bank of Kazakhstan” “Halyk -Life”, JSC was issued the license (#2.2.41 of 08/19/2010) to engage in Life insurance (reinsurance) activity, with inclusion of additional insurance class in the obligatory form of insurance: employee insurance for accidents while he/she performs his/her occupational (office) duties.

As per decree #239 of the Chairperson of the Agency dated August 17, 2010 “Insurance Company “ALATAU”, JSC the license (#2.1.40 of 08/17/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #238 of the Chairperson of the Agency dated August 17, 2010 “Life Insurance Company “Kazkommerts-Life” (Subsidiary Organization of the “Kazkommertsbank”), JSC was issued the license (#2.2.42 of 08/17/2010) to engage in Life insurance (reinsurance) activity, with inclusion of additional insurance class in the obligatory form of insurance: employee insurance for  accidents while he/she performs his/her occupational (office) duties.

The following top executives in financial institutions have been cleared with the Agency:

As at August 17, 2010, the liquidation commission in charge of ‘Valut Tranzit Fund’, an accumulation pension fund, JSC, completed, in full, the settlements with creditors of every order of priority specified in the schedule of claims to that accumulation pension fund in liquidation, namely - order of priority # 2 which means the settlements concerning: -  remuneration of labour and payment of compensation to persons who worked under employment contract, payment of indebtedness concerning social security contributions to the State Fund of Social Security, - payment of maintenance [for children and other incapacitated members of the family] and compulsory pension contributions and also compensations for authors’ contracts; - order of priority # 4 which means “tax liabilities and other obligatory payments to the state budget”; and - order of priority # 5 which means “settlements with other creditors in accordance with legislative acts”.

As per decree #236 of the Chairperson of the Agency dated August 16, 2010 “Insurance Society “TSHASO”, JSC the license (#2.1.12 of 08/16/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #234 of the Chairperson of the Agency dated August 12, 2010 “Insurance Company “Коmmesk-Оmir”, JSC the license (#2.1.1 of 08/12/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #230 of the Chairperson of the Agency dated August 11, 2010 “Insurance Company “Alliance-Policy”, JSC the license (#2.1.4 of 08/11/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #229 of the Chairperson of the Agency dated August 11, 2010 “Centras Insurance” Insurance Company”, JSC the license (#2.1.16 of 08/11/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #228 of the Chairperson of the Agency dated August 11, 2010 “Insurance Company “Atlanta-Policy”, JSC the license (#2.1.8 of 08/11/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #226 of the Chairperson of the Agency dated August 10, 2010 Amirgali Kamalov, was issued the certificate of accreditation (#141 of 08/10/2010) to engage for implementation of estimate activity on insurance market.

As per decrees #225, 227 of the Chairperson of the Agency dated August 10, 2010 “Astana-Finance” Insurance Company”, JSC the license (#2.1.46 of 12/01/2008) to engage in insurance in agriculture of insurance class in the obligatory form of insurance in activity under Non-Life insurance, was revoked (Voluntary) and license (#2.1.46 of 08/10/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #224 of the Chairperson of the Agency dated August 09, 2010 “Insurance Company “EcoPolicy”, JSC the license (#2.1.14 of 08/09/2010) to engage in insurance activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #223 of the Chairperson of the Agency dated August 06, 2010 “Life Insurance Company State Annuity Company”, JSC was issued the license (#2.2.39 of 08/06/2010) to engage in Life insurance activity, with inclusion of additional insurance class in the obligatory form of insurance: third party liability of employer for damaging life and health of the employee in the process of execution of his official (occupational) duties.

As per decree #221 of the Chairperson of the Agency dated August 06, 2010 “Insurance Company “SAYA”, JSC the license (#2.1.31 of 08/06/2010) to engage in insurance activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

 As per decree #220 of the Chairperson of the Agency dated August 06, 2010 Alma Ospanova, was issued the license (#72 of 08/06/2010) to engage in actuarial activity on insurance market.

As per decree #219 of the Chairperson of the Agency dated August 05, 2010 “Insurance Company “Kazkommerts- Policy” (Subsidiary Organization of the “Kazkommertsbank”), JSC the license (#2.1.13 of 08/05/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #218 of the Chairperson of the Agency dated August 05, 2010 “The Subsidiary organization of the European joint stock company “Аllianz S.E.” “Insurance Company “Аllianz Kazakhstan”, JSC the license (#2.1.24 of 08/05/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.  

As per decree #217 of the Chairperson of the Agency dated August 05, 2010 “NTC - New Trust Company”, JSC the license (#0403200462 of 07/20/2006) to engage in investment portfolio management activity, was revoked (Voluntary).

As per decree #215 of the Chairperson of the Agency dated August 04, 2010 “Insurance Company “NOMAD Insurance”, JSC the license (#2.1.38 of 08/04/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #211 of the Chairperson of the Agency dated August 04, 2010 “Halyk – Kazakhinstrakh” Subsidiary Insurance Company of the “Halyk Bank of Kazakhstan”, JSC the license (#2.1.11 of 08/04/2010) to engage in insurance activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #210 of the Chairperson of the Agency dated August 04, 2010 “Subsidiary Organization of the “Nurbank” “Nurpolicy” Insurance Company”, JSC the license (#2.1.34 of 08/04/2010) to engage in insurance (reinsurance) activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #209 of the Chairperson of the Agency dated August 04, 2010 “Insurance Company “Victoria”, JSC the license (#2.1.13 of 08/04/2010) to engage in insurance activity under Non-Life insurance, was renewed, according with the Law of the Republic of Kazakhstan “On changes and amendments to some legislative acts of the Republic of Kazakhstan on binding and mutual insurance, taxation”.

As per decree #186 of the Chairperson of the Agency dated July 16, 2010 Subsidiary Company of the “BTA Bank”-“Temirbank”, JSC the license (#0407100254 of 07/30/2008) to engage in custodian activity on securities market, was revoked (Voluntary) and license (#107 of 07/16/2010) to engage in banking and other operations and in activity on securities market, was renewed, because it has changed its name to “Temirbank”, JSC.

“The Specialized interdistrict economic court of the Karaganda region has approved the liquidation report and liquidation balance sheet of “Insurance Company ‘Valut Tranzit Policy’”, JSC, (see the Court’s determination dated 30 June 2010 and effective from 16 July 2010).
The Justice department of the Karaganda region, Ministry of Justice of the Republic of Kazakhstan, has registered the compulsory liquidation of “Insurance Company ‘Valut Tranzit Policy’”, JSC; see the Department’s order # 3-8/8001 dated 2 August 2010. It is on the basis of this order that this insurance company has been struck from the state register of legal entities.”

“The specialized interdistrict economic court of the city of Almaty passed the judgment dated July 13, 2010, on the compulsory winding up of “Accumulation Pension Fund ‘Korgau’”, JSC, which (the judgment) came into force on July 29, 2010. The Chairperson of the Agency of the Republic of Kazakhstan on regulation and supervision of financial market and financial organizations (the Agency) has appointed a liquidation commission in respect of “Accumulation Pension Fund ‘Korgau’”, JSC, (see the Chairperson’s order No 201 dated July 29, 2010). The Chairperson of the liquidation commission in respect of “Accumulation Pension Fund ‘Korgau’”, JSC , is Ms. Zh.K. Sembayeva, an expert with the Agency’s Department of Liquidation of Financial Organizations; the seat of the liquidation commission is: Abylai khan avenue, building 141, Almaty; phone +7 (727) 272 20 16; +7 (727) 272 69 90. It was on August 4, 2010, that the newspapers “Juridicheskaya gazeta” and “Zan” published notices about the compulsory winding up of “Accumulation Pension Fund ‘Korgau’”, JSC. Claims from the creditors of “Accumulation Pension Fund ‘Korgau’”, JSC, shall be taken up being addressed to the name of the Chairperson of the liquidation commission, Ms. Zh.K. Sembayeva, on working days from 9.00 a.m. till 6 p.m., within 2 months from the day of publication of notice in the newspapers “Juridicheskaya gazeta” and “Zan”, to the above specified address. The claims should be accompanied by the documents the list of which is specified in paragraph 85 of the Rules for the compulsory winding-up of accumulation pension funds; see the Rules which have been approved by the Agency Board in its decree No 79 dated March 2006.”
